Time is Running Out to Comply with Upcoming EEO-1 Reporting Deadline

With a September 30 deadline looming, employers with 100 or more employees need to prepare and submit EEO-1 Component 2 information.

The Component 2 requires employers to report wage information from W-2 forms along with total hours worked by employees by race, gender and ethnicity within 12 pay brackets falling between October 1 and December 31, 2017 and 2018. The deadline is September 30, 2019.

Employers can use the EEOC portal to file 2017 and 2018 pay data.

A few key points to remember when filing your information:

  • If you have multiple business locations, you will need to file completely separate reports for the consolidated company, company headquarters and each individual business location.
  • For exempt employees, employers must report actual hours worked. You can report actual hours worked, if recorded, or a report based on “proxy” hours (40 hours for a full-time employee and 20 hours per week for part-time exempt employees)
  • Employers are directed to use “Box 1 – Wages, tips, other compensation” of the IRS Form W-2 to identify the compensation band in which to count an employee
